New York Attorney General Letitia James is leading the state coalition. Mayor Zohran Mamdani filed a second suit with Chicago, San Francisco and Seattle. Both ask a Southern District of New York judge to freeze green-card denials tied to SNAP, Medicaid and housing aid.
The statute they are fighting is not new. The Immigration Act of 1882 barred entry by anyone likely to become a public charge — a person unable to support himself without loading the American taxpayer. DHS under Trump has restored that standard after a 2022 Biden-era rule narrowed what officers could count. The updated guidance lets officers deny adjustment of status when an applicant is likely to use federal welfare. Figures circulating in patriot briefings put 5.6 million immigrants at risk of losing access and project about $13 billion a year returned to taxpayers.
